Canon “Summer Never Ends” Cashback Campaign – Republic Of Ireland Terms & Conditions

The Republic of Ireland “Summer Never Ends” Campaign consists of two sets of Terms and Conditions, each solely governing their respective Promotion:

A. Section A: Promotional Product Cashback for i-SENSYS, imageFORMULA, imagePROGRAF product ranges Terms and Conditions; and

B. Section B: Upgrade Reward Cashback Promotion for upgrades of qualifying products to imagePROGRAF TM-240 and imagePROGRAF TM-340 devices Terms and Conditions.

SECTION A:  PROMOTIONAL PRODUCT CASHBACK FOR  I-SENSYS, IMAGEFORMULA, IMAGEPROGRAF PRODUCT RANGES TERMS AND CONDITIONS

1. PROMOTIONAL PRODUCTS, PROMOTIONAL PERIOD AND PARTICIPANTS

1.1. This cashback promotion is only available on Purchases made of any of the products listed in Schedule 1 to these Section A Terms and Conditions (the “Promotional Products”, the “Promotional Product Cashback”).

1.2. All other i-SENSYS, imageFORMULA and imagePROGRAF, or Canon products that are not included within Schedules 1 are excluded from this promotion.

1.3. All purchases of Promotional Products must be made within the Republic of Ireland (“ROI”) in EUR between 00.00 BST Friday 27^th September 2024 and 23.59 GMT Friday 27^th December 2024 inclusive (the “Promotional Period”).

1.4. Retailers or resellers of Canon products are not entitled to participate in this cashback promotion.

1.5. Purchases must be genuine purchases for cash or its equivalent.

1.6. All Participants must be aged 18 or over and must be resident in the ROI (the “Territory” and each a “Participant”).

1.7. All Participants are deemed to have agreed to be bound by these Terms and Conditions.

1.8. All Promotional Products must be new and genuine Canon Products. Purchases of second hand, refurbished or reconditioned products, or products which are counterfeit or infringe the intellectual property rights of the Canon group of companies in any way (for example, including but not limited to parallel or “grey” products) will not qualify under this promotion. Please refer to this link for more information on parallel products.

1.9 Some Promotional Products may be sold individually or as part of a bundle, and cashback claims must be made per each purchase of a qualifying item in each of the i-SENSYS, imageFORMULA, imagePROGRAF product ranges (the “Product Ranges” and each a “Product Range”).

1.9.1 Promotional Product Cashback claims must be made and submitted individually for each purchased product from the Product Ranges in accordance with clause 2 below. Participants will receive only one cashback per Promotional Product purchased. Promotional Product Cashback is limited to a maximum of 5 individual cashback claims for each Product Range. If a purchase contains multiple Promotional Products, cashback claims must still be made and submitted individually in respect of each product.

2. HOW TO PARTICIPATE

2.1. To enter the cashback promotion, the Participant must purchase Promotional Product(s) from a participating retailer during the Promotional Period within the Territory AND submit a valid claim online between 00.00 BST on Friday 27^th September 2024 and 23.59 GMT on Monday 27^th January 2025.

2.2. Canon must receive the claim form and supporting proof of purchase within the Promotional Period and within 30 days after the date of purchase. The Promotional Products must be owned by the Participant on the date of the claim.

2.3. The Promotional Products are subject to availability while stocks last.  Canon will not be liable for the failure of retailers to fulfill orders of Promotional Products during the Promotional Period.

2.4. Claims must be submitted by fully and correctly completing a claim form online (which will include specifying a valid European product serial number), at https://www.canon.ie/offers/summer-never-ends/  for a Promotional Product purchased within the ROI:

(i) Participants will need to scan, upload, and attach to the online claim form a photocopy or photo of their physical receipt of their Promotional Product, or online order confirmation for internet purchases.

(ii) For imagePROGRAF products, the proof of purchase must clearly show which reseller the device was purchased from. Participants will then receive an email confirming that their claim has been received.

2.5. If you do not receive a confirmation email within 24 hours of processing your claim, or do not have access to a computer, please contact our Claim Hotline on 0800 044 3251.

2.6. Canon will not process any claims received after the closing date for receipt of claims of 23.59 GMT on Monday 27^th January 2025. Canon will not process claims which are in its opinion incomplete or illegible. Canon will not be responsible for claims delayed or not successfully received.

2.7. Businesses or individuals who make bulk purchases (being more than 5 Promotional Products of each Product Range during the Promotion) will not be eligible participate in this cashback Promotion.

2.8. This promotion is non-transferable, subject to product availability, and cannot be redeemed in conjunction with any other promotion or offer subject to the following exceptions:

(i) The Upgrade Reward Cashback included in our Summer Never Ends Campaign, in accordance with the separate terms and conditions set out at Section B of this document;

(ii) Canon’s 3 Year Warranty Offer for i-SENSYS and imageFORMULA (https://www.canon.co.uk/offers/office-printers-scanners-offer/); and/ or

(iii) Canon promotions also occurring during the Promotion Period that EXPRESSLY state in their terms and conditions that they may be redeemed in conjunction with this cashback promotion.

2.8.1. This Promotion cannot be redeemed if the Participant is an employee of Canon or the Canon Group of companies and utilising an employee discount on the Canon online store.

2.9. Claims must be submitted by the Participant who has made the relevant purchase and claims must not be made by resellers or retailers of Canon products, Canon Partners or distributors (including other agents or third parties).

3. CASHBACK

3.1. Eligible participants who meet the qualifying requirements and submit successful claims will receive cashback as set out in Schedules 1 in the amounts shown for purchases of Promotional Products during the Promotional Period.

3.2. Upon receipt and verification of the claim, Canon will arrange for a direct BACS transfer payment to the Participant’s bank account. No alternative arrangement will be entered into and no cash or cheque will be provided

3.3. Canon will endeavour to transfer via BACS within 4-6 weeks of receipt of a complete and valid claim.

3.4. Only one BACS payment will be issued per valid claim.

3.5. If you are ROI VAT registered and you receive a cashback, it may reduce the taxable value of your purchase and so you may need to reduce your input tax accordingly.

3.6. Where a Promotional Product has been purchased, a cashback claim has been submitted and paid by Canon, in the event that the Participant decides to return the Promotional Product for a refund:

3.7.1. Where the specified item was purchased from the Canon Official Store Canon will deduct the cashback amount paid from any refund due back to the Participant; or

3.7.2. Where the specified item was purchased from any other participating retailer (excluding the Canon Official Store) the participant agrees that they shall repay the cashback received from Canon within 14 days of return of the specified item. The Participant agrees that Canon (through its third-party supplier Benamic of IDA Business and Technology Park, Ring Road, Kilkenny, Ireland) shall contact the Participant by email to arrange for such repayment and to confirm the payment methods available to the Participant.

3.7. Promotional Products that are returned (free of default) for refund or exchange shall not be valid for the cashback promotion and not be eligible for cashback claims. Where a Promotional Product has been purchased, if the Participant decides to return or seek a refund of the Promotional Product, the Participant is no longer eligible to participate in this Promotion in respect of that product and any entitlement to cashback will be withheld.

3.8. If Canon becomes aware of any such fraud, it shall be free to take legal action against any Participants involved. Canon shall have the right, where necessary, to undertake all such action as is reasonable to protect itself against fraudulent or invalid claims including, without limitation, to generate or require further verification as to proof of  purchase/ownership (e.g. Photo of the serial number label, barcodes, as well as the identity, age, and other relevant details of a Participant). This process may involve the Canon sharing information with third parties.

3.9. Canon reserves the right to disqualify incomplete, fraudulent altered or illegible claims which do not comply with these Terms and Conditions. If the Participant fails to comply with these Terms and Conditions, the request will be rejected.

4. THE PROMOTER

4.1. The promoter is Canon (UK) Ltd, company number 01264300 with its registered office address at 4 Roundwood Avenue, Stockley Park, Uxbridge UB11 1AF.

5. DISCLAIMERS

5.1. To the fullest extent permitted by law, Canon shall not be liable for any loss, damage or injury of any nature howsoever caused, sustained by any Participant under this promotion. However, nothing in these rules shall have the effect of excluding or restricting Canon’s liability for personal injury or death caused by the proven negligence of Canon’s employees or agents.

5.2. In exceptional circumstances, Canon may void, amend, and/or change this promotion at any time without incurring any liability whatsoever provided that such changes are necessary and can be justified by objective reasons.

5.3. Canon reserves the right to audit any claims to ensure compliance with these terms and conditions and to request additional information and supporting documents. Canon reserves the right to exclude claims and/or Participants if it suspects that the promotion is being abused in any way. Canon’s decisions in relation to the promotion are final and no correspondence will be entered into.

5.4. If any part of these conditions is found by a court of competent jurisdiction or other competent authority to be invalid, unlawful, or unenforceable, then such part shall be severed from the remainder of these conditions, which shall continue to be valid to the fullest extent permitted by law.

6. DATA

6.1. Canon (UK) Ltd is the Data Controller in respect of any personal data supplied by Participants. Any personal data submitted to Canon (UK) Limited will be processed by (a) Canon (UK) Ltd and its third party supplier Benamic Ltd, IDA Business and Technology Park, Ring Road, Kilkenny, Ireland, for the purpose of administering this Promotion, and, if applicable (b) by Canon (UK) Limited and its associated companies for marketing purposes- in cases where Participants have opted-in to receive marketing communication from Canon. 6.2. If Participants do not wish for their contact information to be used for marketing purposes or to enable Canon to contact them in future regarding similar promotions, they should NOT check the relevant “opt-in” box when completing the claim form.

7. LAW AND JURISDICTION

These Terms and Conditions and any disputes arising out of or in connection with them shall be governed by and construed in accordance with the laws of England and will be subject to the exclusive jurisdiction of the English courts. These Terms and Conditions do not restrict any statutory rights that may be applicable.

Schedule 1 –Promotional Products Cashback

SECTION B:  UPGRADE REWARD CASHBACK PROMOTION FOR UPGRADES OF QUALIFYING DEVICES TO IMAGEPROGRAF TM-240 AND IMAGEPROGRAF TM-340 DEVICES TERMS AND CONDITIONS

1. PROMOTIONAL PRODUCTS, PROMOTIONAL PERIOD AND PARTICIPANTS

1.1. This cashback promotion is only available on purchases of imagePROGRAF TM-240 and imagePROGRAF TM-340 devices that are qualifying upgrades of any of the products listed in Schedule 1 to these Section B Terms and Conditions (the “Upgrade Reward Products”, the “Upgrade Reward Promotion”). 

1.2. All other i-SENSYS, imageFORMULA and imagePROGRAF, or Canon products that are not included within Schedule 1 to these Section B Terms and Conditions are excluded from this Upgrade Reward Promotion.

Upgrade Reward Promotion cashback is limited to a maximum of 5 individual cashback claims per consumer. If a purchase contains multiple imagePROGRAF TM-240 and imagePROGRAF TM-340 devices, cashback claims must still be made and submitted individually in respect of each product.

2. HOW TO PARTICIPATE

2.1. To enter the cashback promotion, the Participant must purchase an imagePROGRAF TM-240 or imagePROGRAF TM-340 device as an upgrade from any of the Upgrade Reward Products listed in Schedule 1 from a participating retailer during the Promotional Period within the Territory AND submit a valid claim online in accordance with these Terms and Conditions between 00.00 BST on Friday 27^th September 2024 and 23.59 GMT on Monday 27^th January 2025.

2.2. Canon must receive the claim form and supporting proof of purchase within the Promotional Period and within 30 days from the date of purchase. The imagePROGRAF TM-240 or imagePROGRAF TM-340 devices and relevant Upgrade Reward Product must be owned by the Participant on the date of the claim.

2.3. The imagePROGRAF TM-240 or imagePROGRAF TM-340 devices are subject to availability while stocks last. Canon will not be liable for the failure of retailers to fulfill orders of products during the Promotional Period.

2.4. Participants of the Upgrade Reward Promotion cashback can claim their cashback as follows:

(i) The Participant purchases an imagePROGRAF TM-240 or imagePROGRAF TM-340 device as an upgrade from any of the products listed in Schedule 1 to these Section B Terms and Conditions;

(ii) The Participant correctly completes and submits the claim form at https://www.canon.ie/offers/summer-never-ends/  for a TM-240 or TM-340 purchased within the UK (which will include specifying a valid European product serial number).

(iii) When the Participant selects the TM-240 or TM-340 product in the form, the Participant will be prompted for additional information. As part of their Upgrade Reward Promotion cashback claim, Participants will need to submit as part of their cashback claim the (i) product name and serial numbers of (ii) the device they are upgrading from and (iii) the imagePROGRAF TM-240 or imagePROGRAF TM-340 device they have upgraded to.

(iv) Participants will need to scan, upload, and attach to the online claim form a photocopy or photo of their physical receipt, or online order confirmation for internet purchases.

(v) Participants must upload a receipt that clearly shows which retailer their imagePROGRAF TM-240 or imagePROGRAF TM-340 device was purchased from. Participants will then receive an email confirming that their claim has been received.

(vi) Canon will not be responsible for disposing of the device that was upgraded.
